Court case against Pimlico Plumbers:

Plumber wins workers' rights battle against Pimlico Plumbers - BBC News - http://www.bbc.co.uk/news/business-38931211

The bit that stands out is:

"The case is about the distinction between Mr Smith's status as either a self-employed contractor or a worker for the company.

He was VAT-registered, and paying tax on a self-employed basis, but worked solely for Pimlico Plumbers for six years."


I thought that HMRC rule IR 35 would mean this person was an employee!
 
this guy wants it both ways I am self employed and would never take this action I know what I am getting into and so did he
heard his boss on the radio saying he got £80k a year self employed would have been £40k paye
in my book the taxman wants to sting him for back tax
 
If we take out the 'earnings' side of things, Plimlico charge their customers a fortune, it seems that both the 'employer' and the 'employee' are having two bites of the cherry.

If a company has someone solely working for them, self employed or not, then that person should have full employee rights. In the piece, Plimlico said they will no longer be able to offer this guy more work, because they want him to work 5 days a week, and will take back 'their' van. He may well be getting more money and pay less tax, but he has less rights, no sick pay, holiday pay, bank holiday pay, personal accident insurance, pension rights etc.

Seems Plimlico, like other such companies/franchises, want to employ persons without the conditions and rights as an employee, in my opinion.

now hes had a heart attack he wants sick pay, funny it wasn't raised in the previous 6 years we cant have it both ways he could have asked for full employment rights 2 years into the job but he knows which deal is the best

Your probably right. I just think these companies, and their 'employees' are riding rough shod over employees and employers rules & regulations and for that matter paying tax.
 
The employer provides a van,tools,work wear,advertising, employment restrictions,tax free monies and set the hours

I wonder why ?

Surely it has nothing to do with freeing the company from employment regulations (which may give a little bit of protection for workers against seedy employers) and what happened to the 3 or so criteria for being deemed self employed,I am surprised it does not seem to interest the Tax man

As for the plumber,he is trying to manipulate a system he was quite happy to take part until it didn't suit
