Code 3......it complies with the BGB in all aspects other than the recommended max of 200 ohms.....and assuming the RCD(s) operate within spec disconnection times are met.
No doubt there will be cries of anguish from some.....but the sole purpose of an EICR is to highlight deviations from BS7671,it is not permitted to bring personal preferences into coding. A code3 is nevertherless recommending improvement, and this could be explained more fully in the report summary.

Personally, I'd also code it 3, with a note in the comments box though looking at GN3 (new version) and the BGB I can't see any reference to a 'recommended max' of 200 ohms, only that values over 200 ohms may not be stable

I agree with the above.
In a TT with all circuits protected by 30mA RCD(s) then the impedance of the earth path could be as low as 1666ohms.

HOWEVER

400ohms is very low. Maybe its not in earth but sitting in a pit filled with hard core?
I would make it a Code 2 and recommend you bang in a new earth rod.

Only while the RCD is working correctly!! lol!!

Agree with wirepuller in this instance, as this is conducting an official EICR to the current wiring regulations/BS7671.

...Not that i particularly agree with this section of them!! lol!!

I take your point...I've always considered this to be a roundabout way of recommending a max of 200ohms.....but you are correct,it's depends on your interpretation.

its in earth, down in cornwall on top of a big granite hill, I think it may take more than one rod to get it down much. PME is available in the area now so will recommend a phone call to the dno.
