Just had a full property rewire completed, My contract was with a registered electrician ( sparky 1 ) , I checked prior to engaging him and he is registered with NIC IEC

The job took five days and the electrician had another electrician working alongside him

When the job was completed I was asked for payment which was made by bank transfer to sparky 1

Some days later I was handed a certificate , but this was completed by sparky 2 ( who I later found out is NOT REGISTERED )

I have refused to accept this certificate and have asked the original electrician to supply a certificate in his name,
I have asked several times for this and he always promises to sort it out.

Is he duty bound to issue a certificate
what can I do if he does not issue a certificate ?

The property may be rented out or sold in the near future so without a Certificate I am going to have problems

He ( sparky 1 ) has promised to e-mail a certificate to me , is this acceptable/legal assuming it is forthcoming ?

Can I report sparky 2 for issuing a certificate when he is unregistered, if so , how do I do this ?

He's done nothing wrong. He just has to be a "skilled person"
 
Anyone can issue a certificate. It’s the person who notifies it to building control that takes on responsibility For the safety of the installation.

I could get several sparkys to work for me.

I can put different sparkies as designer, installer and tester.

but the certificate would be issued by me And notified to building control by me.

however if sparky 2 has issues you with the certificate and he has notified it to building control. Then all is good. If he hasn’t notified it to building control not so good. If he is not registered he probably hasn’t.

check on the certificate who the designer installer and tester are.
 
You should perhaps check though that a building control notice is going to be issued on your behalf by Sparky1. This is as important as the certificate because without it, technically you're breaking the law by failing to notify building control that you've had notifiable works carried out.

An EIC certificate is required for the work. Further it needs to be notified to building control.

It is not in his interests not to, but if it comes to it you can complain to NICEIC.
Are you sure sparky2 isn't registered with another scheme like NAPIT?
It's important the work is notified under part P, and sparky2 either needs to fork out cash or be registered with someone to do that.
 
What is the heading on the Certificate from Sparky 2, if he's not registered with NICEIC then it should not be on paperwork with their heading.
Is Sparky 2 employed by Sparky 1 or is he a subcontractor of Sparky 1?

it shows that sparky 2 id responsible for the DESIGN the CONSTRUCTION and the INSPECTION AND TESTING of the installation.

I am not sure of the working relationship between sparky 1 and sparky 2,
Sparky 1 was originally going to do the work with his apprentice but as his apprentice had to go back to college he ended up getting help from sparky 2

You should receive the Building Control notice that it has been registered. This is what you keep to prove work done has been notified to building Control.

BTW - i used to be registered but no longer want to be, it does not make me a bad person or a bad electrician. Most of my work is commercial and industrial and also specialised. There is a whole army of electricians out there that do not register for the Odd dwelling here and there. However if the sparky 1 and 2 mainly do domestic work then its simpler to register with the cheapest possible scheme out there.

Absolutely no need to be in a scheme to issue a certificate. All that is required is that you are a competent person. You can download and fill it out yourself if you wish, but if you are not competent in electrical work then it's not worth the paoaer it's written on. As for the building control side of things I can't comment as I have no experience of domestic work in the UK.

I'm making no comment about your skills as obviously I've no clue.
But for most ordinary people it would be highly unwise to do this.
The bottom line is that most people wouldn't want to risk having to stand up in court after a fatal accident and attempt to defend that they are skilled and competent, and explain why their inspection hadn't picked up a critical issue.
A properly conducted inspection leaves the inspector certain that the installation is safe to use and that the many variable factors unique to the installation (e.g. circuit lengths, type of earthing, distance of house from supply transformer etc.) will lead to the safe disconnection of the supply in various fault conditions within defined time limits.
A good unskilled inspection is checking the right colours are joined up in the right places with the right size cable and hoping for the best. There's a world of difference.
 
What you have been given is an Installation Certificate which every electrician worth their salt will give you when they have completed any work be this a full installation, a minor works or an EICR.
The Certifcate from Building control is a totally separate thing, this is to say that the work carried out has been notified (Not all work has to be notified), although this is so in your case and this is normally posted out to you by your local council which from my experience can take several weeks.
