So to re-phrase my question, if it wasnt a TT system and the RCD failed what would the code be?
Damn, should have engaged brain before posting that question but in my defence I have been drinking and watching a fine Scarlets rugby win!

If the RCD dont work then effectively you aint got RCD protection so all those rule for C2/C3 apply .....
 
Interesting one. If you aint got any RCD's protecting your installation its only a C3 --- unless its forming part of a TT system or for sockets liable for outside use?

I haven't seen anything suggesting a failed RCD should be a C2 but you could well be correct!

Can anyone throw any definitive guidance as to why its a C2 --- not trying to be contentious here for a change, just for my own edification.

following the general drift of the ESC code guide , C1's are pretty much reserved for items that could cause immediate injury or fire risk.
a faulty rcd doesnt fit that bill really.
in terms of severity , it has "potential" to be a risk rather than be an immediate danger , hence C2
