Deductions from pay for damage to van not caused by me

Im sure some of you have had some severe weather lately, i live just outside of Keighley near Bradford. its a dump.

we had some hailstones the other night the size of golf balls, my van, one of the other lads vans and my gaffers car have a couple of dents here and there from it. as it goes my gaffers car is the worst but my van has got away quite lightly.

hes wanting us to either: pay for the repairs to the dents, pay for the insurance excess (£500) or wait till it goes back to the leasing company to see if they notice. I REALLY had to bite my tounge to the point of drawing blood when he said this....

what you guys think?

im going to wait to see if they notice. they probably wont with mine.

Tell him to sling his hook, its his van, his insurance, not yours.

On what grounds is he wanting you to pay for it? I would like to know the reason.

How can he say that? he pays the van insurance, right? his problem not yours, dipstick

I think the damage could be regarded as 'fair wear and tear' by the leasing company. Unless the boss agreed with you that you would keep the van under cover, it's not your fault.

You could also call the leasing company anonymously to ask "what if hailstones damage the vehicle while it's in my care?"

Finally, the dents may push out; a professional dent specialist might fix them all for very little money.

Did you sign anything to say you would pay the excess if any damage occurred when he gave you the van? Most bigger companies do this.

in my contract it states i have to pay for damages but that's about it. doesn't state whether it applies to me actually damaging the van, but as far as i see it, if the van is in his possession (which it sometimes is) does that also mean i have to pay the excess/repair if he damages it.

i normally dont argue with it if it is my fault, i took my wing mirror off afew month back and paid up straight away. my fault fair play. ive had a look on whatcar and dont think the leasing company will be bothered about either van as the dents are all quite small and there isnt many on either.

i think hes just peed his car took a right battering....

I took a peugeot partner back once to northgate that I had for 3years with a dented bonnet and miss lodged bumper after rolling in to the back of someone in traffic and never heard a thing. :biggrin:

Just remember he can't take cash from you wages without your say so, if he does he is breaking the law, fair enough if the damage was your fault then, maybe yes you should pay up, only maybe though.

i will second that, no insurance will pay out for an "act of god" so you cant be expected to.

I live at Bingley and we missed them, but a lad i know in the gym had 3 hail stones come through his conservatory roof that evening!

Stand your ground - as other said he cannot deduct from your wages.

LOL at least something positive has come out of this.
The tight fisted so and so has probably got the cheapest insurance available.
Hence the 500 quid excess.
That bit in your contract relating to the van, looks like a cut and paste job off the internet, cheaper than a solictor.

His van, he pays. Why should you pay? All you do is drive it for him. And did the damage occur due to your driving? No..
So tell him he can whistle for it!

the thing is i would never agree to those policies where you pay the damage. unless it has a very clear list of things that i will pay for example. taking wing mirror off.

its a work van it will get scratches and dents eventually
